Prosecutors responded Tuesday to Hunter Biden’s request to subpoena documents from Donald Trump and former Justice Department officials in the gun case against him. “His proposal is unreasonable and should be rejected,” they wrote in response. Biden, 53, pleaded not guilty in October to violating laws prohibiting drug users from owning guns when he bought a revolver in 2018.
Last month, his legal team filed documents in federal court in Delaware asking to subpoena Trump, his attorney general Bill Barr and two other former senior Justice Department officials, Richard Donohue and Jeffrey Rosen. They want documents, including diary entries discussing Hunter Biden. as a defense that he was the victim of political interference. They say Biden was subjected to “certain instances that appear to suggest sustained, improper and partisan pressure.”
In their response, prosecutors said, “His charges and subpoena requests focus on likely inadmissible, far-reaching and vague categories of documents relating to the actions and motives of individuals who failed to make an appropriate prosecutorial decision in his case.” The investigation into Hunter Biden’s taxes and gun purchases began in 2018 while Trump was president. However, prosecutor Leo Wise noted in his response that the charges were filed only this year. He called it an “inconvenient truth.”
The subpoena for Trump included a demand: “All personal records (including diaries, journals, memoirs, memoranda or notes) for the relevant period of time discussing or relating to Hunter Biden, including, but not limited to, references to any official or unofficial decision, discussion or request to investigate or prosecute Hunter Biden.” The move marks another turning point in a case that has already attracted a ton of attention. This is the first time in history that a child of a sitting US president has been prosecuted. But documents filed last month showed how his defense is beginning to take shape.
‘Mister. Biden is seeking specific information from three former Justice Department officials and the former president that reflects the crux of his defense: a possible vindictive or selective prosecution resulting from a relentless pressure campaign that began under the last administration in violation of Mr. Biden’s principles. Fifth Amendment rights,” his lawyers wrote to the judge. In his memoirs, Barr described how irritated he was by Trump for pushing the status of the Hunter Biden investigation on him.
And in 2020, after Trump lost the election to Hunter’s father, the then-president criticized Barr for not disclosing the existence of the investigation before Election Day. He said Barr was a “big disappointment” in a series of tweets suggesting the revelation would give Republicans an electoral advantage.
The president’s troubled son has long been the target of attacks by Trump and his allies in Congress. They accuse him of corrupt business practices and try to link his father to his activities. Those allegations are at the heart of the impeachment inquiry being led by House Republicans. The White House called the investigation politically motivated.
