Dramatic courtroom moment woman accused of stabbing her boyfriend to death learns he was sleeping with her friend as their junkie home from hell is revealed

A woman accused of murdering her boyfriend in a suburban drug den has stormed out of court after learning she was not his only lover.

Linda Lee Falzon, 43, is accused of killing James McColgan, 61, at his home in Sunbury, on Melbourne’s north-west outskirts, where the couple lived with other drug addicts and dealers.

On Tuesday, Falzon learned that her friend had also slept with Mr. McColgan, prompting her to leave the prison media room where she was watching a preliminary hearing that will determine whether she will stand trial.

Melbourne Magistrates Court heard Falzon is accused of plunging a knife into McColgan’s chest and leaving him bleeding on the floor.

The motive for the alleged murder of the tattoo artist has not been established, but several other people have been identified as possible suspects.

One of those people allegedly told Falzon to stab Mr. McColgan with a screwdriver.

The house was given to Mr McColgan by his mother and turned into a suburban cesspool where addicts gathered to sell, buy and use drugs.

At the time of his death, Mr McColgan had just received a $100,000 settlement for being the victim of childhood sexual abuse.

Samantha Attard, who was 23 years younger than Mr McColgan, kept her sexual relationship with Mr McColgan a secret until Monday, when she told Falzon’s lawyer Adam Chernock.

It was Ms Attard who found Mr McColgan’s bloodied body and reported it to police.

The court heard Mr McColgan owed Ms Attard thousands of dollars at the time and had promised to buy her a car.

“I didn’t want to tell anyone anything because of the age difference. I am the same age as his son,” Ms Attard told the court.

The court heard Ms Attard slept with Mr McColgan behind Falzon’s back for five months before his death.

But it was her description of how the couple first came to terms with their relationship that sent Falzon storming out of the Dame Phyllis Frost Center’s media room.

“He came up to me, stood behind me and said, ‘I think I’m going to kiss you.’ We were very close, we had a lot in common, we always made each other laugh and went from one thing to another,” Ms Attard told the court.

“I didn’t want to tell anyone too much because of my age.”

Falzon refused to return for the hearing, forcing Chernock to continue the case without her.

Ms Attard said Falzon had no idea she had slept with her boyfriend.

Falzon met Mr McColgan when he was homeless.

The court heard police found McColgan bleeding at the front door of the house and he died at the scene despite attempts by paramedics to resuscitate him.

Police who arrived at the house described it as filthy, with dirty, uncapped syringes strewn throughout.

Mr Chernock said the house was littered with food waste and the rooms were filled with “garbage and debris”.

The mess was this: An unarmed officer found Falzon in the backyard, hiding behind an abandoned shopping cart, after detectives supposedly “secured the crime scene.”

Ms Attard told the court that up to half a dozen people and a dog lived in the house and at least eight people a day came to buy drugs from the dealer who lived there.

She told the court that the people in the house were using drugs and smoking marijuana and methamphetamine.

She told the court that one of the residents once threatened to “cut her up from top to bottom.”

It is known that this man “went crazy” with a hammer and destroyed the place.

Ms Attard said the man once told Falzon how to carry out a murder in what was known as the “screwdriver incident”.

‘You know what to do. Hammer it in. Hit it hard,” Ms. Attard recalls him saying.

“I heard a conversation between him and Mrs. Falzon.”

The hearings are ongoing.
